Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the RAdata website, online store, products, and services (collectively, the “Services”), which are provided by RAdata, LLC and, for water treatment services, its affiliate RAdata Water Treatment, LLC (together, “RAdata,” “we,” “us,” or “our”). By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Services or make a purchase. By using the Services, you represent that you meet these requirements and that any information you provide is accurate and current.
2. Use of the Services
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your own personal or internal business purposes. You agree not to:
- Use the Services in any unlawful manner or for any unlawful purpose;
- Interfere with or disrupt the Services or the servers or networks that support them;
- Attempt to gain unauthorized access to any portion of the Services or another user’s account;
- Copy, reproduce, distribute, or create derivative works from our content except as expressly permitted;
- Use any automated means to access or scrape the Services without our prior written consent.
3. Intellectual Property
The Services and all content, features, and functionality — including text, graphics, logos, images, and software — are owned by RAdata or its licensors and are protected by intellectual property laws. The RAdata name, logo, and related marks are our trademarks and may not be used without our prior written permission.
4. Products and Purchases
We sell radon test kits and related products through our online store.
Orders. Your order is an offer to purchase. We may accept or decline any order, and we reserve the right to limit or cancel quantities.
Pricing. Prices, promotions, and availability are subject to change without notice. We make reasonable efforts to display accurate pricing but are not responsible for typographical errors; if an item’s price is stated incorrectly, we may cancel or correct the order.
Payment. You agree to provide current, complete, and accurate payment information. Payments are processed by third-party payment providers.
Shipping. Shipping timeframes are estimates and not guarantees. Risk of loss passes to you upon delivery to the carrier.
5. Services
We provide mold, radon, and water services. Requesting a quote or estimate does not create a binding agreement; specific services are governed by the separate service agreement, proposal, or work order you enter into with us. Estimates are based on the information available at the time and may be adjusted based on on-site conditions. Service availability varies by location, and some services may not be offered in all states.
6. SMS/Text Messaging Terms
If you opt in to receive text messages from RAdata, you agree to receive recurring informational messages (such as appointment reminders and account notifications) at the phone number you provide. Message frequency varies. Message and data rates may apply. You can opt out at any time by replying STOP, after which no further messages will be sent; reply HELP for help. Carriers are not liable for delayed or undelivered messages. For details on how we handle your information, see our Privacy Policy. Your phone number and SMS opt-in data are never sold or shared with third parties or affiliates for their own marketing or promotional purposes.
7. User Submissions
If you submit reviews, comments, or other content to us, you grant RAdata a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with the Services. You are responsible for the content you submit and represent that you have the rights to submit it.
8. Third-Party Links
The Services may contain links to third-party websites or resources. We are not responsible for the content, products, or practices of any third-party sites, and your use of them is at your own risk.
9. Disclaimer of Warranties
THE SERVICES AND ALL PRODUCTS AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, or secure.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RADATA AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless RAdata, its affiliates, and their officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your violation of these Terms, or your violation of any law or third-party right.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the state and federal courts located in New Jersey, and you consent to personal jurisdiction and venue in those courts.
13. Changes to These Terms
We may update these Terms from time to time. Changes are effective when posted on this page, and your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
